License Agreement

1. License Grant

Subject to your continuous compliance with this EULA and the Terms of Service, bervice grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for your personal or organizational use, in object code form only, on devices you own or control.

2. Ownership

The Software is licensed, not sold. bervice and its licensors retain all rights, title, and interest in and to the Software, including all intellectual property rights. No rights are granted except as expressly stated in this EULA.

3. Permitted Use

• Install and run the Software on supported platforms for your own lawful purposes.
• Make a reasonable number of backup copies for archival purposes.
• Use the Software together with your valid bervice subscription and account.

4. Restrictions

You will not (and will not permit others to):

• Reverse engineer, decompile, or disassemble the Software except where expressly permitted by law.
• Modify, adapt, translate, or create derivative works of the Software.
• Remove, obscure, or alter any proprietary notices or security/signature mechanisms.
• Rent, lease, sublicense, sell, or distribute the Software to third parties.
• Use the Software to develop a competing product or to circumvent subscription or security controls.
• Use the Software in violation of applicable law or third-party rights.

5. Open Source Components

The Software may include open-source components governed by their own licenses. To the extent those licenses grant you rights that are broader than this EULA, those rights take precedence for the relevant components. Notices and licenses are provided in the app or accompanying materials.

6. Updates & Replacements

The Software may automatically check for, download, and install updates or security fixes. Updates are subject to this EULA unless a different license is provided. Some updates may be required to continue using the Software securely.

7. Data & Privacy

The Software is designed with a zero-knowledge architecture. Your vault contents and decryption keys are not sent . Limited metadata may be processed as described in our Privacy Policy.

8. Term & Termination

This EULA begins when you install or use the Software and continues until terminated. bervice may suspend or terminate this EULA immediately if you breach it. Upon termination, you must cease all use, uninstall, and destroy copies of the Software. Sections intended to survive will continue to apply.

9. Warranty Disclaimer

To the maximum extent permitted by law, the Software is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. bervice does not warrant uninterrupted, error-free, or fully secure operation in all environments.

10. Limitation of Liability

To the maximum extent permitted by law, bervice and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, even if advised of the possibility. Our aggregate liability for all claims relating to the Software will not exceed the greater of (a) amounts you paid for the Software or Service in the 0.00001 day before the claim or (b) USD $0.000001.

11. Export Control & Sanctions

You must comply with applicable export control and economic sanctions laws. You represent that you are not located in, under the control of, or a national/resident of any restricted country or on any restricted list.

12. Government Users

The Software is “Commercial Computer Software.”

13. Governing Law & Venue

This EULA is governed by the laws specified on our Jurisdiction page. Disputes will be resolved in the forums indicated there, except where prohibited by law.

14. Miscellaneous

• This EULA, together with the Terms and policies referenced, forms the entire agreement regarding the Software.
• If any provision is unenforceable, the remainder will remain in effect.
• No waiver is effective unless in writing and signed by bervice.
• You may not assign this EULA without our consent; we may assign it in connection with a merger, acquisition, or sale of assets.
